- Prohibited (Article 5). Social scoring, manipulative subliminal techniques, real-time biometric ID in public spaces with narrow law-enforcement exceptions, emotion recognition in workplaces and schools, untargeted scraping of facial images. In force since February 2, 2025. Fines up to €35M or 7% of global turnover. Zero gradation. You're either offering the prohibited practice or you're not.
- High-risk (Article 6 + Annex III). Recruitment scoring, credit scoring, education access, critical infrastructure, law enforcement, migration/border control, certain product safety integrations. Conformity assessment required. Most enforcement begins August 2, 2026 for legacy systems.
- Limited-risk (Article 50). Chatbots, deepfakes, emotion-recognition systems (where not prohibited), biometric categorization. Transparency obligations only. Users must be informed they're interacting with AI. In force August 2, 2026.

What "Conformity Assessment" Actually Costs
The €38,000 spend I mentioned earlier was almost entirely for one feature: a recruitment-screening AI a friend's startup was selling to mid-market HR platforms. That sits squarely in Annex III. The conformity assessment required a risk-management system documented and operational, data governance documentation showing training data lineage and quality controls, technical documentation per Annex IV (model architecture, performance metrics, bias testing, validation procedures), a human oversight mechanism in the product, an accuracy and cybersecurity baseline, a post-market monitoring plan, a quality management system, a notified body audit for some high-risk types (€15-30K typical), and registration in the EU database for high-risk AI systems.
Annual maintenance of this regime is another €15-25K. It's real money for a 12-person startup. The founders ultimately pivoted the feature to be an "AI-assisted shortlisting suggestion" with mandatory human screening, which dropped them out of high-risk classification entirely.
This is the playbook: if you can redesign a feature to take humans out of the decision loop, do it. If you can put humans back in the loop and document it, do that. The high-risk classification turns on whether the AI determines the outcome or merely informs a human who does. - Inventory. Spreadsheet of every AI feature in production. Columns: input type, output type, EU users yes/no, decision impact, human in loop?
- Classify. Map each row to a risk tier using the matrix above. Aim to keep everything below high-risk if possible.
- Implement transparency. Add a banner or disclosure to chat surfaces. Add C2PA signing to image generation. Add "AI-generated" labels to anything user-facing.
- Documentation. Write a one-page "AI System Description" per feature: what it does, what model, what data, what controls. Store it in the wiki under
/compliance/ai-act. - Incident process. Add an incident category for AI Act issues to your runbook. Define who is responsible (usually CTO).
The same engineering hygiene that makes building SRE for 50 services with a six-person team viable is what makes this compliance lift tractable for a small team. Inventory, classification, documentation: it's the same operational discipline that keeps the rest of your infrastructure honest.
Where Enforcement Is Heading

Treat the documentation as a product artifact, not a legal artifact. Write it in plain language. Update it when the system changes. Tie its review cadence to your existing engineering process. For example, require an updated AI System Description as part of the PR template for any change to a model-facing component. The marginal cost is minutes per change. The value when the Commission writes is enormous.
The Compliance Calendar to Pin Above Your Desk
The AI Act is not a problem for next year. It's a problem for this quarter if your product serves European users. The good news is most startups can comply with a few weeks of focused work rather than a six-figure legal engagement. The bad news is that ignoring it now costs orders of magnitude more later. The teams getting this right are treating it like security: a small ongoing cost, baked into product reviews, owned by an engineer with a name. Don't be the startup that learns about Article 50 from a Commission letter. Get ahead of the audit, do the inventory, ship the disclosures, and turn compliance into a competitive advantage when your enterprise prospects start asking about it on procurement calls.
